Based on the historical facts given in this module, assess if the American Civil War was inevitable.
Analyze if the United States Supreme Court can settle legal and moral issues through judiciary review. In your response, provide a documented example of a modern parallel of a legal or moral issue settled by the United States Supreme Court.
American Civil war (1861-1865) was greatly influenced by a series of historical events and institutional circumstances that eventually made it inevitable. Adams (2020) explained that the heated struggles and controversies over slavery between the Northerners and the Southerners played a major role in influencing the hostility and conflict that subsequently paved the way for the American Civil war. Neely (2017) explained that a number of key developments such as the Compromise of 1850, amendments to the Fugitive Slave Act and The Lincoln-Douglas debates of 1858 sought to address and avert the crisis between the South and North. However, other notable developments such as the Supreme Court’s decision to upheld slavery in U.S. territory, in the Dred Scott Case of 1857, repealing of the Kansas-Nebraska Act 1854, and the publishing of Uncle Tom’s Cabin (an anti-slavery novel) offered significant groundwork for the Civil war, making the conflict to be inevitable (Adams, 2020; OpenStaxCollege, n.d.)The Civil War Assignment Discussion Paper.
Whilst the Supreme Court of the United States is constitutionally mandated with the responsibility of conducting judicial review, the capacity of the Court to settle moral and legal issues through judicial review were brought to question by its decisions in the Missouri’s Drett Scott Case, 1846-1857. Nevertheless, the decisions of the United States Supreme Court on the intricate issue of abortion equally revealed the extent to which its capacity to address legal or moral issues through judicial review remains controversial (Ziegler, 2017). Whilst Roe v. Wade case (1973) stood out as a landmark ruling that led to the establishment of the constitutional right to abortion in the U.S., the Supreme Court overturned this ruling in a 5-4 decision in 2022. As a result, therefore, although the Supreme Court has attempted to exercise its power when it comes to the realization of judicial review, a significant portion of these decisions have been marred in controversy and contested debates The Civil War Assignment Discussion Paper.
