The terms government over-reach and government responsible vary in how different people interpret them. Generally, different individuals interpret different situations based on their emotional state in that some may project anger and anxiety while others may use critical reasoning when evaluating problems[1]. When defining the term government overreach, it means that the government involved uses its powers beyond the mandate provided by the constitution. For instance, there are many instances when governments have engaged in an overreach, especially when trying to curb terrorism. In such instances, the government overlooks its responsibility to protect their privacy rights but instead, like in 2001, the country engaged in illegal dragnet surveillance[2]. Such actions are against the constitution’s main goals since the government should be in the first line condemning cyber security since it risks the citizens’ rights to privacy. For the responsible government, it enrolls its laws and regulations that align with the constitution, primarily using its parliamentary powers.[3] Therefore, any government perceived as responsible needs to enhance its efforts in ensuring that it is answerable to its parliament. That is because most people who form the government are always directly elected by the public, and most are within the different parliamentary bodies. Also, any responsible government needs to engage democratic principles[4]. My policy area of interest concerns those policies that will help reduce recidivism rates in the United States for violent criminals without involving parole supervision. When reflecting on my policy area, government over-reach and responsible government are also evident. For instance, government over-reach is evident when criminals fail to reform even after being re-arrested every time and in most cases for the same crime. In such a case, most criminal justice bodies which are part of the government’s most trusted departments in curbing insecurity in the country, may end up over-reaching. For instance, there are instances where instead of re-arresting an individual, some are incapacitated. Some people may interpret such actions of incapacitating the violent criminals as an over-reach since they infringe such criminals’ rights to live freely in a given location. The reason such may be a government over-reach action is that the 14th amendment of the United States Constitution prohibits the deprivation of individuals’ liberty in society by any form of government.[5]
However, to prevent an action like incapacitation from being a form of government over-reach, the government needs to engage its parliamentary bodies to evaluate it critically[6]. That is to ensure that the actions do not go against the projected clauses in the constitution concerning ways to deal with criminal justice systems. Hence, policymakers within the criminal justice system must engage in critical research and define various terms concerning suspects’ rights to ensure that they present enough evidence to lawmakers. Such a measure is to assure the lawmakers that an action like incapacitating a violent criminal after multiple arrests will not be going against the constitution. Hence, the criminal justice system, one of the most powerful bodies of the US federal government, follows parliamentary orders, which act as one form of a responsible government. Using the criminal justice lens, therefore, a responsible government involves its parliamentary powers that the American citizens duly elected to represent them in forming objective laws concerning their safety and well-being.
